How do I avoid being audited?
In case I don't want someone running through all my downloaded tunes?

you cant - they will do it, if they feel your illegaly downloading

make sure you have reciepts for all downloads or they will say in court your illegaly obtaining music

also make sure you have all licences (see a lawyer to make sure your legal)

so when someone hires you how do you know who it is ?

Quote:

The General Manager of MIPI says, "Our surveillance programs run 7x days a week and investigators work a 24x hour roster period. This means we get to cover a lot of ground. We average an arrest every two weeks. By way of example, we currently have over 634 DJs, Jukebox operators and venues (and their operators) in the process of being prosecuted civilly. A further 250 or more Dj's are awaiting criminal prosecution from all over Australia. Over 250 notices have been served in the past year for MP3 piracy alone (2010)."

"Apart from issuing fines, prosecutors can confiscate all the equipment involved (eg: CD Players, Amps, Speakers, Whole Computers etc) for destruction. Even if you are lucky enough to convince a court that you should get some equipment back, you can be sure that it will have been seized for so long that it is out of fashion or superseded!"

"At any given time, MIPI is able to identify current or emerging trends in infringing behaviour. This is one of the things that make us so successful. At present there is a real problem with operators and venues using hard drives to play illegally copied music and, no matter which way you view it, this is illegal. Over the years, our investigators have heard every conceivable excuse for this form of piracy."

"Yes, using hard drives to play copied music without the authorisation of the copyright owner is piracy, no matter what your explanation.
The sheer size of the problem here has resulted in MIPI adopting newer approaches to piracy."

"We recently undertook undercover sting operations targeting Dj's, Clubs, Venues and some jukebox operators in Melbourne, Adelaide and Perth, we will be taking the operation on the road again real soon. So put simply, you will never know if your customer is just that, or the anti-piracy investigation unit coming for you."

In closing Manger of MIPI: says, "Copyright is what gives us all our business or work. Without it you don’t have the ‘music business’. So if you know of someone ripping off music let us know! Our email address is mipi@mipi.com.au , We hope to hear from you real soon!"

So there you have it, if you have copied music onto hard drive without permission, sooner or later you will be caught and fined... It would seem that there might just be a few folk out there in for the odd long sleepless night!.........

have a nice sleep!

What about music that is copied onto your computer from CDs that you have now sold to used record stores? Are you then meant to delete those tunes? Seems all a bit stupid really, are they actually going to raid your house if you're a DJ and suspect you of piracy?

From 'Music for DJ's" http://www.mipi.com.au/IgnitionSuite...0Right%20Thing[1].pdf

'What if my ‘mix CD’ is going to be distributed for free?
Regardless of whether you are making a profit or not from your CD, copying or sampling music without the permission of the
copyright owners breaks the law.'

That seems a bit harsh that a DJ can't promote their mix to mates, club owners, online etc without getting a licence... Can't see that happening for all the underground DJs and bedroom bangers,,,

DJ Dennis, do you work for these guys or something? Has any DJ actually ever gone to jail in Australia for not having the licence to mix in public? Fair enough on filesharing, but once you have the tune, it's up to you on how you use it creatively.

I really don't see DJ's getting done for playing actual Dance music... designed for DJing.

Alot of artists give away tunes and alot of tunes are not even in print anymore, DJ's are notorious for making multiple backups on their collection and they build a collection of the period of years and years, there is no way they can reasonably expect you to have receipts from as far back from the 80s and 90s, hell I don't even think I would have any record of the tracks I got from Beatport more than a year ago.

I think this applies more to top 40 style mainstream music, from record companies that like protecting their IP's, if DJ's were ever cracked down on for playing EDM, It would severely damage the industry.

On what legal grounds can they confiscate your gear? I can't just walk into your house and take all your gear because you pirated my tunes. Hell, I can't even walk into your house at all! Why can they?

Question: International DJ is playing all promos from associated labels and artists, using hand labelled burnt CD-Rs, how could they prove they're playing promos and not illegal downloads?

Just to add to this, plenty of high profile DJ's have been caught and prosecuted over the years. Nik Fish, Pee Wee Ferris and some such and such RnB DJ's have all been done. It never has been a scapegoat to write promo only on a cd. That is one of the biggest urban legends in the industry as far back as I can remember.

The fact of the matter is this
1. You cannot buy music from Beatport etc etc and play it out without the relevant license
2. They CAN and WILL seize property that has been aquired relevant to DJ*ng. This is obtained through the courts and enforced by the police.
3. They do know where you play and when. I know this, I run quite a few venues around Australia and they know if we are putting on a night, who is playing etc. If we say otherwise, they send us a nice letter and bill each time.
4. The venue is required to have a PPCA and APRA license. This allows us to play background music (inhouse system like nightlife) and also for DJ's. Our PPCA fees are $2.75 per person, per capacity, per night. ie: One of my venues is a 1000 capacity. So, each night we have a DJ on - we pay $2.75 x 1000 people, regardless if there is 2 people in there. APRA isn't so bad, only about 17k a year, PPCA is fucked.
5. As Dennis said, is up to you if you wish to run the gauntlet, but I do know from mates who work for PPCA and APRA, they have teams that trawl forums such as ITM, FB accounts, Soundclound, Myspace etc etc etc. They also check things like magazines, do site visits etc. Is alot like drink driving, you can get away with it a few times, but sooner or later, you will get caught.
6. If you want to make mixes and give them to people, you are best of either A. burning it and giving it to them personally or use a file sharing thing like megaupload etc to send to them. Don't put on play lists, makes it much harder for them to ID (they do use programs like shazam etc to find most of them though)
7. Try and keep receipts, I know it is hard and heck, I find it hard to keep track of mine sometimes. You do not need to provide receipts for Vinyl
8. Like it or not, it is the law and they have the full backing of the courts in these matters. You can rant and rave till you are blue about how it is unfair, you shoudl be able to manipulate it blah blah blah, but the fact of the matter is, you cannot, they are the rules, the laws and if you do not like it, do something about it. Speak to your local MP etc.

Not trying to be a smart arse as your comments are a whole lot better than "Menace the Dennis" who quite frankly shits me with his whole doom and terror bullshit. Fucken 48 year old from perth who thinks he's king fucking kong!

But are you saying that you have to provide a receipt for purchased cd's then?

Ok, I will clarify it. The reason why you do not need to provide receipts for such things as vinyl, is because it is a physical source of music. ie: is pretty much unheard of to reproduce a piece of vinyl (yes, i know it can be done, but 12k for a vestax vinyl cutter in your loungeroom is out of reach of most people) You also do not need to provide a receipt if you buy the physical cd. ie: if you go into HMV etc and buy the single.

If you download your music, you will need to provide a receipt. If you also play from a hardrive, from what i have been informed at seminars etc, it is technically illegal and using programs such as Serato etc is technically illegal. I will try and find the info I got from them a few years back. Is at home on my laptop, so please bare with me if I don't get back ASAP

If you say download a track, then want to play it out on CD, you will need a license to transfer the medium of music, plus a license to even DJ. I think it is all crap personally, but, us in the AHA and industry fought this quite alot for years through the federal courts and made some minor wins (ie: the costs and restraints they wanted was far more than what the outcome was)

Are you kidding??? I thought by fact that the venue is paying rights to broadcast music you were covered?

You need your own personal license to play CDs of music you've bought digitally? What if it's direct from a hard drive/USB/SD card into a CDJ?

And how does Serato et al fit into it? If it's still on the HDD on your lappy you bought it on, there's been no shift of medium

My venue and license cover you. Actually, if you get caught with illegal music, I can be fined $5000. You have to have a separate license to switch mediums and using Serato etc is clasified as that. Is crap i know, but meh

these discussions are pretty by the bye if you simply buy all your music.

It's not that hard.

But how do you know I dont....

I am happy to be audited. And I didn't say you have no idea. But you are prancing around this forum like a total douche with no respect pointing the finger and blaming everyone here for being pirates. If you had done some more reading in this forum you would find that most of us frown on stealing music.

Show some respect.

...Not really.
Aren't you a traktor fanboi now?
Moving bought music from the download destination to traktors crates is considered a format shift.

Hey Archie, would like to know more about this one. Not being sarcastic but it sounds interesting that you can get life for something like music.
